4 TIPS TO TAKE ACTION AFTER THE WEBCAST

  1. Distinguish early who is going to take care of your child to support them with the day-to-day activities of daily living, and who will have the legal right to make decisions for them when they can’t.
  2. Consider opening a joint bank account with your family member as a creative workaround to navigating friction with financial institutions in managing your money. If your child is under 18, be sure to open a bank account well before they turn 18 as it will make things easier in the long run.
  3. Help your family member create a CRA online account and help them do their taxes to ensure they are involved in the process even if you designate someone else to manage the taxes for you.  
  4. Consider if your family member can create a Power of Attorney document with the help of a legal professional, for personal care or property, to avoid the need for guardianship later. In 2019, Community Living Ontario launched the Right to Decide Project. Partnering with the IRIS Institute and PooranLaw. The project was designed to identify situations in which the legal capacity of people who a disability were challenged and to demonstrate the ways in which Supported Decision Making can overcome these challenges. The Right to Decide site, contains many resources related to supported-decision making. 
In 2012, Jenny Hatch, a 29-year-old woman from Providence RI was forced by the courts to live in a group home despite her strong preference to live with friends who loved her and wanted to share their home with her. Jenny's story illustrates the issues with guardianship and the impact it has on the ability for people to make decisions.
